By downloading, installing, or using any game or application ("Services") published by Zygle Ltd. ("Zygle," "we," "our," or "us"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not access or use our Services. We may update these Terms from time to time, and your continued use of our Services constitutes acceptance of any changes.
2. Eligibility
You must be at least 13 years of age to use our Services. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using our Services, you represent and warrant that you meet these eligibility requirements.
3. License to Use
Subject to your compliance with these Terms, Zygle grants you a limited, non-exclusive, non-transferable, revocable license to access and use our Services for your personal, non-commercial entertainment purposes. You may not: (a) copy, modify, or distribute our Services; (b) reverse engineer, decompile, or disassemble any part of our Services; (c) rent, lease, lend, sell, or sublicense our Services; (d) use our Services for any commercial purpose without our prior written consent; (e) use automated scripts, bots, or cheats to interact with our Services.
4. User Accounts
Some of our Services may allow you to create an account or save progress. You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account. Zygle is not liable for any loss or damage arising from your failure to protect your account credentials.
5. In-App Purchases
Our Services may include optional in-app purchases ("IAP"). All purchases are final and non-refundable, except as required by applicable law or the policies of the platform provider (e.g., Google Play). Prices are subject to change without notice. Virtual items or currency purchased within our Services have no real-world monetary value and cannot be exchanged for cash or transferred to other users. Zygle reserves the right to manage, regulate, modify, or remove virtual items or currency at its sole discretion.
6. User Conduct
You agree not to:
- Violate any applicable laws or regulations
- Harass, abuse, or harm other users
- Transmit any harmful, offensive, or illegal content
- Interfere with or disrupt the integrity or performance of our Services
- Attempt to gain unauthorized access to our systems or other users' accounts
- Use our Services to transmit any viruses, malware, or other harmful code
- Engage in any activity that could damage our reputation or business
7. Intellectual Property
All content within our Services — including but not limited to graphics, designs, text, audio, video, trademarks, logos, game mechanics, and software — is the property of Zygle Ltd. or its licensors and is protected by intellectual property laws. You may not use, reproduce, or distribute any content from our Services without our prior written consent.
8. Advertisements
Our Services may display advertisements from third-party ad networks. By using our Services, you agree that Zygle and its advertising partners may serve ads within the Services. These ads may be targeted based on your usage data, preferences, or other information collected in accordance with our Privacy Policy. Zygle is not responsible for the content, accuracy, or practices of third-party advertisers.
9. Disclaimer of Warranties
OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. ZYGLE DISCLAIMS ALL WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT OUR SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZYGLE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES, WHETHER BASED ON WARRANTY, CONTRACT, TORT, OR ANY OTHER LEGAL THEORY. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.
11. Termination
Zygle may terminate or suspend your access to our Services at any time, with or without cause, and with or without notice. Upon termination, your license to use our Services will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property provisions, disclaimers, and limitations of liability.
12. Governing Law
These Terms are governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
